Summary:
The followers of Ahl Al-Bayt-asws have been instructed not to take their disputes to the judges appointed by the governments.ย If a believer gets his rights from the judgment of a ruler or a judge, he will neither reap the benefits nor find any blessings in what he succeeds in obtaining from his lawsuit. We have also been advised not to take a position of a judge, appointed by a government, e.g., Imam-asws says: Therefore, shun the judging for you cannot stand with it (uphold it)!โ[1]
Believers must appoint a Schoolar of Ahadith if they have a dispute:
ุงูุฅุญุชุฌุงุฌ ุนููู ุนูู ูุฑู ุจููู ุญูููุธูููุฉู ููุงูู: ุณูุฃูููุชู ุฃูุจูุง ุนูุจูุฏู ุงูููููู ุน ุนููู ุฑูุฌููููููู ู ููู ุฃูุตูุญูุงุจูููุง ุจูููููููู ูุง ู ูููุงุฒูุนูุฉู ููู ุฏููููู ุฃููู ู ููุฑูุงุซู ููุชูุญูุงููู ูุง ุฅูููู ุงูุณููููุทูุงูู ูู ุฅูููู ุงููููุถูุงุฉู ุฃู ููุญูููโ ุฐููููู
(The book) โAl Ihtijajโ โ From Umar Bin Hanzala who said,
โI asked Abu Abdullah-asws about two men from our companions (people of Wilayah). There is a dispute between them regarding a debt or inheritance, so they take the case (dispute) to the ruler or to the judges (appointed by the ruler), โIs that permissible?โ
ููุงูู ุน ู ููู ุชูุญูุงููู ู ุฅูููููููู ู ููู ุญูููู ุฃููู ุจูุงุทููู ููุฅููููู ูุง ุชูุญูุงููู ู ุฅูููู ุงููุฌูุจูุชู ูู ุงูุทููุงุบููุชู ุงููู ูููููููู ุนููููู ูู ู ูุง ุญูููู ู ูููู ุจููู ููุฅููููู ูุง ููุฃูุฎูุฐู ุณูุญูุชุงู ูู ุฅููู ููุงูู ุญูููููู ุซูุงุจูุชุงู ูููู ููุฃูููููู ุฃูุฎูุฐููู ุจูุญูููู ู ุงูุทููุงุบููุชู ูู ููุฏู ุฃูู ูุฑู ุงูููููู ุนูุฒูู ูู ุฌูููู ุฃููู ููููููุฑู ุจููู ููุงูู ุงูููููู ุนูุฒูู ูู ุฌูููู- ููุฑููุฏูููู ุฃููู ููุชูุญุงููู ููุง ุฅูููู ุงูุทููุงุบููุชู ูู ููุฏู ุฃูู ูุฑููุง ุฃููู ููููููุฑููุง ุจูููโ
He-asws said: โWhoever refers to them for judgment, true or false, he has rather taken his case to the false god (Jibt) and the tyrant (Taghout) which he has been forbidden from, and whatever he judges for him with, he has rather taking an ill-gotten gain, and even if his right is established for him, because he has taken by a judgment of the tyrant, and Allah-azwj Mighty and Majestic has Commanded him to disbelieve him. Allah-azwj Mighty and Majestic Says: They are intending to summon each other to the judgment of the tyrant, although they have been Commanded to disbelieve in him [4:60]โ.

I said, โSo how should they deal with it, and they have differed (disagreement regarding a matter)?โ
ููุงูู ููููุธูุฑูุงูู ู ููู ููุงูู ู ูููููู ู ู ูู ูููู ููุฏู ุฑูููู ุญูุฏููุซูููุง ูู ุนูุฑููู ุญูููุงููููุง ูู ุญูุฑูุงู ูููุง ูู ุนูุฑููู ุฃูุญูููุงู ูููุง ููููููุฑูุถูููุง ุจููู ุญูููู ุงู ููุฅููููู ููุฏู ุฌูุนูููุชููู ุนูููููููู ู ุญูุงููู ุงู
He-asws said: โThey should look for the one from you who has reported our-asws Ahadith, and recognises our-asws permissible(s) and our-asws prohibitions, and recognises our-asws rulings, so they should be satisfied with him as a judge, for I-asws have made him (the narrator of the Ahadith) to be a judge upon you all!
ููุฅูุฐูุง ุญูููู ู ุจูุญูููู ู ูู ููู ู ููููุจููููู ู ููููู ููุฅููููู ูุง ุจูุญูููู ู ุงูููููู ุงุณูุชูุฎูููู ูู ุนูููููููุง ุฑูุฏูู ูู ุงูุฑููุงุฏูู ุนูููููููุง ููุงูุฑููุงุฏูู ุนูููู ุงูููููู ูู ูููู ุนูููู ุญูุฏูู ุงูุดููุฑููู ุจูุงูููููู
If he were to judge with a ruling and he (disputant) does not accept it from him, rather he has taken lightly with a Ruling of Allah-azwj and has rejected upon us-asws, and the rejecter upon us is the rejecter upon Allah-azwj, and he would be upon the borders of association (Shirk) with Allah-azwj!โ

I said, โSupposing each one of them had chosen a man from our companions, and they agree that they would be looking into their rights, but they differ in what they judge, so the two judges differ regarding your-asws Ahadith?โ
ููุงูู ุฅูููู ุงููุญูููู ู ู ูุง ุญูููู ู ุจููู ุฃูุนูุฏูููููู ูุง ูู ุฃูููููููููู ูุง ูู ุฃูุตูุฏูููููู ูุง ููู ุงููุญูุฏููุซู ูู ุฃูููุฑูุนูููู ูุง ูู ููุง ููููุชูููุชู ุฅูููู ู ูุง ููุญูููู ู ุจููู ุงููุขุฎูุฑู
He-asws said: โThe (final) judgment is what is judged by their most just, and their most understanding, and their most truthful regarding the Hadith, and their most devout (pious), and what the other one had judged with should not be turned to!โ
ููููุชู ููุฅููููููู ูุง ุนูุฏูููุงูู ู ูุฑูุถููููุงูู ุนูุฑูููุง ุจูุฐููููู- ููุง ููููุถููู ุฃูุญูุฏูููู ูุง ุตูุงุญูุจููู
I said, โSupposing they are both just, satisfactory, well-known with that, one of them does not surpass the other?โ
ููุงูู ููููุธูุฑู ุฅูููู ู ูุง ููุงูู ู ููู ุฑูููุงููุชูููู ูุง ุนููููุง ููู ุฐููููู ุงูููุฐูู ุญูููู ูุง ุงููู ูุฌูู ูุนู ุนููููููู ุจููููู ุฃูุตูุญูุงุจููู ููููุคูุฎูุฐู ุจููู ู ููู ุญูููู ูููู ูุง ูู ููุชูุฑููู ุงูุดููุงุฐูู ุงูููุฐูู ููููุณู ุจูู ูุดููููุฑู ุนูููุฏู ุฃูุตูุญูุงุจููู ููุฅูููู ุงููู ูุฌูู ูุนู ุนููููููู ููุง ุฑูููุจู ููููู
He-asws said: โIt should be looked at what was from their reporting from us-asws regarding that (case) which they had judged, what there is consensus upon between your companions. It should be taken from their rulings, and leave the unusual which isnโt well-known in the presence of your companions, for where there is consensus, there is no doubt in it!
ููุฅููููู ูุง ุงููุฃูู ููุฑู ุซูููุงุซูุฉู ุฃูู ูุฑู ุจูููููู ุฑูุดูุฏููู ููููุชููุจูุนู ูู ุฃูู ูุฑู ุจูููููู ุบูููููู ููููุฌูุชูููุจู ูู ุฃูู ูุฑู ู ูุดููููู ููุฑูุฏูู ุญูููู ููู ุฅูููู ุงูููููู ุนูุฒูู ูู ุฌูููู ูู ุฅูููู ุฑูุณูููููู ุต
But rather, the matters are three โ a matter its guidance is clear so it should be followed, and a matter its error is clear so it should be avoided, and a problematic matter. Its ruling should be referred to Allah-azwj Mighty and Majestic and to His-azwj Rasool-saww.
ูู ููุฏู ููุงูู ุฑูุณูููู ุงูููููู ุต ุญูููุงูู ุจูููููู ูู ุญูุฑูุงู ู ุจูููููู ูู ุดูุจูููุงุชู ุชูุชูุฑูุฏููุฏู ุจููููู ุฐููููู ููู ููู ุชูุฑููู ุงูุดููุจูููุงุชู ููุฌูุง ู ููู ุงููู ูุญูุฑููู ูุงุชู ูู ู ููู ุฃูุฎูุฐู ุจูุงูุดููุจูููุงุชู ุงุฑูุชูููุจู ุงููู ูุญูุฑููู ูุงุชู ูู ูููููู ู ููู ุญูููุซู ููุง ููุนูููู ู
And Rasool-Allah-saww had said: โHalal (Permissible) is clear, and Haram (Prohibition) is clear, and suspect matters fluctuate between that. The one who leaves the suspect matters will be saved from the Prohibitions, and the one who takes with the suspect matters will indulge in the Prohibitions, and he will be destroyed from where he does not know!โ

I said, โSupposing there were two Ahadith from you-asws are well-known having been reported by the trusted ones, from you-asws all (Imams-asws)?โ
ููุงูู ููููุธูุฑู ู ูุง ููุงูููู ุญูููู ููู ุญูููู ู ุงููููุชูุงุจู ูู ุงูุณูููููุฉู ูู ุฎูุงูููู ุงููุนูุงู ููุฉู ููููุคูุฎูุฐู ุจููู ูู ููุชูุฑููู ู ูุง ุฎูุงูููู ุญูููู ููู ุญูููู ู ุงููููุชูุงุจู ูู ุงูุณูููููุฉู ูู ููุงูููู ุงููุนูุงู ููุฉู
He-asws said: โWhatever his judgment is compatible with Judgment of the Book and the Sunnah and opposes the general Muslims should be taken with, and whatever of his judgment opposes Judgment of the Book and the Sunnah and is compatible to the general Muslims should be neglected!โ
ููููุชู ุฌูุนูููุชู ููุฏูุงูู ุฃู ุฑูุฃูููุชู ุฅููู ููุงูู ุงูููููููููุงูู ุนูุฑูููุง ุญูููู ููู ู ููู ุงููููุชูุงุจู ูู ุงูุณูููููุฉู ุซูู ูู ููุฌูุฏูููุง ุฃูุญูุฏู ุงููุฎูุจูุฑููููู ููููุงูููู ุงููุนูุงู ููุฉู ูู ุงููุขุฎูุฑู ููุฎูุงูููู ุจูุฃููููููู ูุง ููุฃูุฎูุฐู ู ููู ุงููุฎูุจูุฑููููู
I said, โMay I be sacrificed for you-asws! What is your-asws view if they were both jurists, recognising its ruling from the Book and the Sunnah? Then we find one of the Hadith being compatible with the general Muslims and the other opposing, which of the two should we take from the two Ahadith?โ
ููุงูู ููููุธูุฑู ุฅูููู ู ูุง ููู ู ุฅููููููู ููู ููููููู ููุฅูููู ู ูุง ุฎูุงูููู ุงููุนูุงู ููุฉู ููููููู ุงูุฑููุดูุงุฏู
He-asws said: โOne should look at when they are inclining towards, for whatever opposes the general Muslims, the rightful guidance is in itโ.
ููููุชู ุฌูุนูููุชู ููุฏูุงูู ููุฅููู ููุงููููููู ู ุงููุฎูุจูุฑูุงูู ุฌูู ููุนุงู
I said, โMay I be sacrificed for you-asws! Supposing both the Ahadith are compatible with them all?โ
ููุงูู ุงููุธูุฑููุง ุฅูููู ู ูุง ููู ูููู ุฅููููููู ุญููููุงู ูููู ู ูู ููุถูุงุชูููู ู ููุงุชูุฑูููููู ุฌูุงููุจุงู ูู ุฎูุฐููุง ุจูุบูููุฑููู
He-asws said: โLook at what their rulers and their judges are inclining towards, leave it aside and take with the other one!โ
ููููุชู ููุฅููู ููุงูููู ุญููููุงู ูููู ู ุงููุฎูุจูุฑููููู ุฌูู ููุนุงู
I said, โSupposing their rulers are compatible with both the Ahadith together?โ
ููุงูู ุฅูุฐูุง ููุงูู ููุฐููููู ููุฃูุฑูุฌููู ูู ูููู ุนูููุฏููู ุญูุชููู ุชูููููู ุฅูู ูุงู ููู ููุฅูููู ุงููููููููู ุนูููุฏู ุงูุดููุจูููุงุชู ุฎูููุฑู ู ููู ุงููุงููุชูุญูุงู ู ููู ุงููููููููุงุชู ูู ุงูููููู ุงููู ูุฑูุดูุฏู
He-asws said: โWhen it was like that, postpone it and pause at it until you meet your Imam-asws, for the pausing at the suspicious matters is better than the storming into the destruction, and Allah-azwj is the Guideโ.[2]

Tafseer Al-Ayyashi โ From Yunus, a disciple of Ali,
From Abu Abdullah-asws having said: โOne who has a dispute between him and his brother so he calls him to a man from his companion to judge between them but he refuses except that he will raise it to the ruler, he is like the one who has gone for judgment to the false god (Jibt) and the tyrant (Taghout), and Allah-azwj has Said: They are intending to summon each other to the judgment of the tyrant, although they have been Commanded to disbelieve in him, and the Satan intends to stray them with a far straying [4:60]โ.[3]

(The book) โTafseer Al Ayyashiโ โ From Abu Baseer,
From Abu Abdullah-asws regarding Words of Allah-azwj Exalted: Have you not seen those who are alleging that they do believe in what is Revealed unto you and what was Revealed from before you? They are intending to summon each other to the judgment of the tyrant [4:60].
ููููุงูู ููุง ุฃูุจูุง ู ูุญูู ููุฏู ุฅูููููู ูููู ููุงูู ูููู ุนูููู ุฑูุฌููู ุญูููู ููุฏูุนูููุชููู ุฅูููู ุญููููุงู ู ุฃููููู ุงููุนูุฏููู ููุฃูุจูู ุนููููููู ุฅููููุง ุฃููู ููุฑูุงููุนููู ุฅูููู ุญููููุงู ู ุฃููููู ุงููุฌูููุฑู ููููููุถููุง ูููู ููุงูู ู ูู ูููู ุญูุงููู ู ุฅูููู ุงูุทููุงุบููุชู
He-asws said: โO Abu Muhammad! It is that if there was a right for you upon a man so you call him to the judges of the Just people (followers of Ahl Al-Bayt-asws) but he refuses upon you except he will raise your case to the judges of the tyrannical people in order for them to judge for him, he would be from the ones taking a case to the tyrantโ.[4]
Judgement of a Judge is always flawed:
ุงูุฅุญุชุฌุงุฌ ุนููู ุณูุนูุฏู ุจููู ุฃูุจูู ุงููุฎูุตููุจู ููุงูู: ุฏูุฎูููุชู ุฃูููุง ูู ุงุจููู ุฃูุจูู ููููููู ุงููู ูุฏููููุฉู ููุจูููููุง ููุญููู ููู ู ูุณูุฌูุฏู ุงูุฑููุณูููู ุต ุฅูุฐู ุฏูุฎููู ุฌูุนูููุฑู ุจููู ู ูุญูู ููุฏู ุน ููููู ูููุง ุฅููููููู ููุณูุงุกูููููู ุนููู ููููุณูู ูู ุฃูููููู ุซูู ูู ููุงูู ู ููู ููุฐูุง ู ูุนููู
(The book) โAl Ihtijajโ โ From Saโad Bin Abu Al Khaseyb who said,
โI and Ibn Abu Layla entered Al-Medina. While we were in Masjid of the Rasool-saww when Jaโfar-asws Bin Muhammad-asws entered. We stood up to him-asws. He-asws asked me about myself and my family, then said: โWho is this one with you?โ
ููููููุชู ุงุจููู ุฃูุจูู ููููููู ููุงุถูู ุงููู ูุณูููู ูููู
I said, โIbn Abu Layla, judge of the Muslims!โ
ููููุงูู ููุนูู ู
He-asws said: โYesโ.
ุซูู ูู ููุงูู ูููู ุชูุฃูุฎูุฐู ู ูุงูู ููุฐูุง ููุชูุนูุทูููู ููุฐูุง ูู ุชูููุฑูููู ุจููููู ุงููู ูุฑูุกู ูู ุฒูููุฌููู ูู ููุง ุชูุฎูุงูู ููู ููุฐูุง ุฃูุญูุฏุงู
Then he-asws said to him: โYou take the wealth of this one and give it to this one, and you separate between the man and his wife and you donโt fear anyone in this?โ

He said, โYesโ.
ููุงูู ููุจูุฃูููู ุดูููโุกู ุชูููุถูู
He-asws said: โSo by which thing do you judge?โ
ููุงูู ุจูู ูุง ุจูููุบูููู ุนููู ุฑูุณูููู ุงูููููู ุต ูู ุนููู ุฃูุจูู ุจูููุฑู ูู ุนูู ูุฑู
He said, โWith whatever has reached me from Rasool-Allah-saww, and from Abu Bakr and Umarโ.
ููุงูู ููุจูููุบููู ุฃูููู ุฑูุณูููู ุงูููููู ุต ููุงูู ุฃูููุถูุงููู ู ุนูููููู
He-asws said: โHas it reached you that Rasool-Allah-saww had said that your most judicial is Ali-asws?โ
ููุงูู ููุนูู ู
He said, โYesโ.
ููุงูู ูููููููู ุชูููุถูู ุจูุบูููุฑู ููุถูุงุกู ุนูููููู ุน ูู ููุฏู ุจูููุบููู ููุฐูุง
He-asws said: โSo how come you are judging with other than the judgment of Ali-asws, and this has reached you?โ
ููุงูู ููุงุตูููุฑูู ููุฌููู ุงุจููู ุฃูุจูู ููููููู ุซูู ูู ููุงูู ุงููุชูู ูุณู ููููููุณููู ุฒูู ููููุง ูู ุงูููููู ููุง ุฃููููููู ููู ู ููู ุฑูุฃูุณูู ููููู ูุฉู ุฃูุจูุฏุงู
He (the narrator) said, โThe face of Ibn Abu Layla paled. Then he-asws said: โSeek a companion for yourself. By Allah-azwj, I-asws will not speak to you from my-asws head a single word, ever!โ[5]
ุงูุฎุตุงู ุงุจููู ุงููู ูุชูููููููู ุนููู ุงูุณููุนูุฏูุขุจูุงุฏูููู ุนููู ุงููุจูุฑูููููู ุนููู ุฃูุจูููู ุนููู ุงุจููู ุฃูุจูู ุนูู ูููุฑู ุฑูููุนููู ุฅูููู ุฃูุจูู ุนูุจูุฏู ุงูููููู ุน ููุงูู: ุงููููุถูุงุฉู ุฃูุฑูุจูุนูุฉู ููุงุถู ููุถูู ุจูุงููุญูููู ูู ูููู ููุง ููุนูููู ู ุฃูููููู ุญูููู ูููููู ููู ุงููููุงุฑู ูู ููุงุถู ููุถูู ุจูุงููุจูุงุทููู ูู ูููู ููุง ููุนูููู ู ุฃูููููู ุจูุงุทููู ูููููู ููู ุงููููุงุฑู ูู ููุงุถู ููุถูู ุจูุงููุจูุงุทููู ูู ูููู ููุนูููู ู ุฃูููููู ุจูุงุทููู ูููููู ููู ุงููููุงุฑู ูู ููุงุถู ููุถูู ุจูุงููุญูููโ ูู ูููู ููุนูููู ู ุฃูููููู ุญูููู ูููููู ููู ุงููุฌููููุฉู
(The book) โAl Khisaalโ โ Ibn Al Mutawakkil, from Al Saโdabady, from Al Barqy, from his father, from Ibn Abu Umeyr raising it to,
Abu Abdullah-asws said: โThe judgments are four โ a judge judges with the truth and he does not know that it is the truth, so, he would be in the Hellfire; and a judge judging with the falsehood and he does not know that it is false, so he would be in the Hellfire; and a judge judging with the falsehood and he knows that is it false, he would be in the Hellfire; and a judge judging with the truth and he knows that it is true, he would be in the Paradiseโ.[6]
A Fallible cannot be Just in his judgement
ููู ุงูุฑุถุง ุนููู ุงูุณูุงู โ ุงุนูููู ู ุฃูููู ุงููููุถูุงุฉู ุฃูุฑูุจูุนูุฉู ููุงุถู ููููุถูู ุจูุงููุจูุงุทููู ูู ูููู ููุนูููู ู ุฃูููููู ุจูุงุทููู ูููููู ููู ุงููููุงุฑู ูู ููุงุถู ููููุถูู ุจูุงููุจูุงุทููู ูู ูููู ููุง ููุนูููู ู ุฃูููููู ุจูุงุทููู ูููููู ููู ุงููููุงุฑู ูู ููุงุถู ููุถูู ุจูุงููุญูููู ูู ูููู ููุง ููุนูููู ู ุฃูููููู ุญูููู ูููููู ููู ุงููููุงุฑู ูู ููุงุถู ููุถูู ุจูุงููุญูููู ูู ูููู ููุนูููู ู ุฃูููููู ุญูููู ูููููู ููู ุงููุฌููููุฉู ููุงุฌูุชูููุจู ุงููููุถูุงุกู ููุฅูููููู ููุง ุชููููู ู ุจููู
(The book) โFiqh Al-Reza-aswsโ โ โKnow that the judgments are four โ a judge judging with the falsehood and he knows that it is false, so he would be in the Hellfire; and a judge judging with the falsehood and he does not know that it is false, he would be in the Hellfire; and a judge judging with the truth and he does not know it is true, he would be in the Hellfire; and a judge judging with the truth and he knows it is true, he would be in the Paradise! Therefore, shun the judging for you cannot stand with it (uphold it)!โ[7]
Fairness in dealing with an aggressor:
ูู [ููุฑููููโ] ุฑููููู ุฃูููููู ุน ููุงูู ุฌูุงููุณุงู ููู ุฃูุตูุญูุงุจููู- [ุฅูุฐู ู ูุฑููุชูโ] ููู ูุฑููุชู ุจูููู ู ุงู ูุฑูุฃูุฉู ุฌูู ููููุฉู ููุฑูู ูููููุง ุงููููููู ู ุจูุฃูุจูุตูุงุฑูููู ู ููููุงูู ุน- ุฅูููู ุฃูุจูุตูุงุฑู ููุฐููู ุงููููุญูููู ุทูููุงู ูุญูโ ูู ุฅูููู ุฐููููู ุณูุจูุจู ููุจูุงุจูููุง ููุฅูุฐูุง ููุธูุฑู ุฃูุญูุฏูููู ู ุฅูููู ุงู ูุฑูุฃูุฉู ุชูุนูุฌูุจููู ููููููููุงู ูุณู ุฃููููููู ููุฅููููู ูุง ูููู ุงู ูุฑูุฃูุฉู ููุงู ูุฑูุฃูุชููู
And it is reported that he-asws (Ali Amir Al-Momineen-asws) was seated among his-asws companions when a beautiful woman passed by him-asws. The people gazed at her with their eyes. He-asws said: โThe eyes of these stallions are covetous, and that is the cause of their looking. So, whenever one of you looks at a woman who fascinates him, then let him touch his wife, for rather she is a woman like his womanโ.
ููููุงูู ุฑูุฌููู ู ููู ุงููุฎูููุงุฑูุฌู ููุงุชููููู ุงูููููู ููุงููุฑุงู ู ูุง ุฃููููููููู- [ููุงููโ] ููููุซูุจู ุงููููููู ู ููููููุชูููููู ููููุงูู ุน ุฑูููููุฏุงู ุฅููููู ูุง ูููู ุณูุจูู ุจูุณูุจูู ุฃููู ุนููููู ุนููู ุฐูููุจูโ
A man from the Kharijites said, โMay Allah-azwj Kill him-asws a Kafir! How understanding he-asws is!โ The people leapt up to kill him. He-asws said: โGently! But rather it is an insult (reviling) for an insult (reviling) or pardoning from a sinโโ.[8]
ููุชูุงุจู ุงููุบูุงุฑูุงุชูุ ููุฅูุจูุฑูุงูููู ู ุจููู ู ูุญูู ููุฏู ุงูุซููููููููู ุนููู ุฅูุณูู ูุงุนูููู ุจููู ุฃูุจูุงูู ุนููู ุนูู ูุฑูู ุจููู ุดูู ูุฑู ุนููู ุณูุงููู ู ุงููุฌูุนูููููู ุนููู ุงูุดููุนูุจูููู ููุงูู: ููุฌูุฏู ุนูููููู ุน ุฏูุฑูุนุงู ูููู ุนูููุฏู ููุตูุฑูุงููููู ููุฌูุงุกู ุจููู ุฅูููู ุดูุฑูููุญู ููุฎูุงุตูู ููู ุฅููููููู ููููู ููุง ููุธูุฑู ุฅููููููู ุดูุฑูููุญู ุฐูููุจู ููุชูููุญููู ูู ููุงูู ู ูููุงูููู ููุฌูููุณู ุฅูููู ุฌูููุจููู ูู ููุงูู ููุง ุดูุฑูููุญู ุฃูู ูุง ูููู ููุงูู ุฎูุตูู ูู ู ูุณูููู ุงู ู ูุง ุฌูููุณูุชู ุฅููููุง ู ูุนููู ูู ููููููููู ููุตูุฑูุงููููู
(The book) โKitab Al Gharaatโ of Ibrahim Bin Muhammad Al Saqafy, from Ismail Bin Aban, from Amro Bin Shimr, from Salim Al Jufy, from Al Shaby who said,
โAli-asws found a shield of his-asws in the possession of a Christian. He-asws came with him to Shureyh (the judge) bringing his-asws dispute to him. When Shureyh looked at him he went on to move aside, and he-asws said: โStay in your place!โ He-asws sat to his side and said: โO Shureyh! If a Muslim had disputed me-asws, I-asws would not have sat except with him, but he is a Christian.
ูู ููุงูู ุฑูุณูููู ุงูููููู ุต ุฅูุฐูุง ููููุชูู ู ูู ุฅููููุงููู ู ููู ุทูุฑูููู ููุฃูููุฌูุฆููููู ู ุฅูููู ู ูุถูุงูููููู ูู ุตูุบููุฑููุง ุจูููู ู ููู ูุง ุตูุบููุฑู ุงูููููู ุจูููู ู ููู ุบูููุฑู ุฃููู ุชูุธูููู ููุง
And Rasool-Allah-saww had said: โWhen you and them were in a road, drive them to its narrowness and belittle them just as Allah-azwj has Belittle them without being oppressiveโ.
ุซูู ูู ููุงูู ุนูููููู ุน ุฅูููู ููุฐูุง ุฏูุฑูุนูู ููู ู ุฃูุจูุนู ูู ููู ู ุฃูููุจู
Then Ali-asws said: โThis is my-asws shield, I-asws did not sell nor did I-asws gift!โ
ููููุงูู ููููููุตูุฑูุงููููู ู ูุง ููููููู ุฃูู ููุฑู ุงููู ูุคูู ูููููู
He (Shureyh) said to the Christian, โWhat is Amir Al-Momineen-asws saying?โ
ููููุงูู ุงููููุตูุฑูุงููููู ู ูุง ุงูุฏููุฑูุนู ุฅููููุง ุฏูุฑูุนูู ูู ู ูุง ุฃูู ููุฑู ุงููู ูุคูู ูููููู ุนูููุฏูู ุฅููููุง ุจูููุงุฐูุจู
The Christian said, โThe shield is not except my shield, and Amir Al-Momineen-asws is not in my view except a liar!โ
ููุงููุชูููุชู ุดูุฑูููุญู ุฅูููู ุนูููููู ุน ููููุงูู ููุง ุฃูู ููุฑู ุงููู ูุคูู ูููููู ูููู ู ููู ุจููููููุฉู
Shureyh turned to Ali-asws. He said, โO Amir Al-Momineen-asws! Is there any proof?โ
ููุงูู ููุง
He-asws said: โNo!โ
ููููุถูู ุจูููุง ููููููุตูุฑูุงููููู ููู ูุดูู ููููููุฆูุฉู ุซูู ูู ุฃูููุจููู ููููุงูู ุฃูู ููุง ุฃูููุง ููุฃูุดูููุฏู ุฃูููู ููุฐููู ุฃูุญูููุงู ู ุงููููุจููููููู ุฃูู ููุฑู ุงููู ูุคูู ูููููู ููู ูุดูู ุจูู ุฅูููู ููุงุถูููู ูู ููุงุถููููโ ููููุถูู ุนููููููู ุฃูุดูููุฏู ุฃููู ููุง ุฅููููู ุฅููููุง ุงูููููู ููุญูุฏููู ููุง ุดูุฑูููู ูููู ูู ุฃูููู ู ูุญูู ููุฏุงู ุนูุจูุฏููู ูู ุฑูุณูููููู ุงูุฏููุฑูุนู ูู ุงูููููู ุฏูุฑูุนููู ููุง ุฃูู ููุฑู ุงููู ูุคูู ูููููู
So, he judged with it to be for the Christian. The man walked a while, then came back. He said, โAs for me, I testify that this is the ruling of the Prophet-as! Amir Al-Momineen-asws walked with me to his-asws judge, and his-asws judged judges against him-asws. I hereby testify that there is no god except Allah-azwj Alone, there is no associate for Him-azwj, and that Muhammad-saww is His-azwj servant and His-azwj Rasool-saww! By Allah-azwj, the shield is your-asws shield), O Amir Al-Momineen-asws!โ
ููุฎูุฑูุฌู ู ูุนู ุฃูู ููุฑู ุงููู ูุคูู ูููููู ุน ุฅูููู ุตููููููู ููุฃูุฎูุจูุฑูููู ู ููู ุฑูุขูู ููููุงุชููู ู ูุนู ุนูููููู ุน ุงููุฎูููุงุฑูุฌู ููู ุงููููููุฑูููุงูู
He went out with Amir Al-Momineen-asws to (the battle of) Siffeen. The one who saw him informed me, he fought the Kharijites along with Ali-asws in (the battle of) Al-Naharwanโ.[9]
